OFFICIAL SWEEPSTAKES RULES

THE FOLLOWING SWEEPSTAKES IS VALID ONLINE ONLY TO LEGAL RESIDENTS IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC). Sonicbids, Corporation (“Sonicbids”) 500 Harrison Ave 404R Boston, MA 02118 (“Sponsor”) is offering the 2012 Sonic Summer Sweeps (“Sweepstakes”), which is being administered by Sonicbids.
ELIGIBILITY: The Sweepstakes is offered and open only to legal residents of, and residing within, the 50 United States and District of Columbia and Canada (excluding Quebec) who, at the time of entry, are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is greater. Residents of Puerto Rico are not eligible to enter or win.
HOW TO ENTER: Beginning at or around 12:00:01 am Eastern Time (“ET”) on or around MAY 28, 2011 and ending at or around 11:59:59 pm ET on or around MAY 30, 2012 (the “Sweepstakes Period”), you may enter the Sweepstakes in any of the following ways:
i) online by visiting http://open.spotify.com/user/sonicbids/playlist/7KzxSnUzdgeLtj0F9yZh3x and listening to the Sonicbids Summers Tunes playlist, then go to http://www.facebook.com/sonicbids and post the name of your favorite band or your favorite song featured.
GRAND PRIZES: One (1) Grand Prize Winner shall win the Grand Prize consisting of: A Gama-Go Flipper Guitar Spatula. The Spatula has Average Retail Value (“ARV”) of $14.99. Sponsors are not responsible for misplaced, lost, stolen or tampered with prizes. Prizes are not redeemable for cash; nor are they transferable or substitutable, except by Sponsors at their sole discretion. All other costs not specifically stated herein, including all federal, state or local taxes is solely each Grand Prize Winner’s responsibility. Limit: Only one (1) Sweepstakes Prize per person or household address regardless of email address used.
GENERAL PRIZE CONDITIONS: No exchanges. The spatula user assumes all risks of personal injury incidental to the event, whether occurring prior to, during, or subsequent to using the spatula, and holder voluntarily agrees that the Sponsor, venue/facility, league or team, artist(s) performing, participants, participating clubs, and all of their respective agents, officers, directors, owners and employees are expressly released from any claims arising from such causes. The Grand Prize Winners/users bear all the risks of using the spatula. Prizes lost or stolen cannot be replaced. The resale or attempted resale of a prize is prohibited and if discovered will result in the prize being voided without the award of any substitute prize, exchange or payment of any cash equivalent value.
All costs, taxes, fees, and expenses associated with the Grand Prize or the acceptance and use of any element of the Grand Prize not specifically addressed above is the sole responsibility of the Winners. All federal, state and local taxes on the prize is the responsibility of the winners. Grand Prize Winners will be issued a 1099 tax form for the ARV of the prize. The Sponsors shall solely determine the specifics of all aforementioned elements of the prize in the Sweepstakes. Some restrictions may apply.
HOW THE GRAND PRIZES WILL BE DETERMINED: The potential Grand Prize Winner will be selected in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about June 1, 2012 by the Sponsor. The odds of winning depend on the total number of all eligible entries received during the Sweepstakes Period.
GRAND PRIZE WINNER NOTIFICATION: Sponsors anticipate Grand Prize Winners will be contacted by email on or about June 1, 2012 (subject to change) by the Sponsors.
LIMITATIONS OF LIABILITY/RELEASE/INTERNET: No liability or responsibility is assumed by Sponsors & Others resulting from any user’s participation in or attempt to participate in the Sweepstakes or his/her ability or inability to download any information in connection with participating in the Sweepstakes. No responsibility or liability is assumed by Sponsors & Others, and you hereby agree to release and discharge Sponsors & Others for all such responsibility and liability, for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Websites in whole or in part for any reason; traffic congestion on the Internet or the Websites; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, viruses, bugs, worms; or destruction of any aspect of the Sweepstakes or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Sweepstakes. Sponsors & Others are not responsible for any typographical errors in these Official Rules, Sweepstakes materials or the announcement of Prizes, or any inaccurate or incorrect data contained in the Websites. The use of any robotic, automatic, macro, programmed, third party or like methods in this Promotion are prohibited and the use or attempted use of s Use of the Websites is at user’s own risk. Sponsors & Others are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the Sweepstakes, use of the Websites or the download of any information from the Websites. By participating in the Sweepstakes, a participant releases Sponsors & Others from any and all claims, damages or liabilities arising from or relating to participation in the Sweepstakes. By accepting a prize, Winners agree that Sponsors & Others shall not be liable for any loss or injury resulting from participation in the Sweepstakes, or acceptance or use of any Prize or Prize-related activity whether or not hosted by Sponsors. Sponsors & Others are not liable in the event that any portion of the Sweepstakes is cancelled due to weather, fire, strike, acts of war or terrorism, any “Force Majeure Event”, or any other condition beyond its reasonable control. If for any reason the Sweepstakes is not capable of running as planned, including without limitation, infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, actions by third parties, or any other causes which corrupt or affect or may corrupt or affect the intended administration, operation, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsors reserve the right, at its sole discretion to cancel, modify or terminate the Sweepstakes or any portion of it and proceed in a manner it deems fair and reasonable, which manner shall include the selection of Grand Prize Winners from among eligible entries received prior to such cancellation, modification or termination. Further, Sponsors reserve the right, at their sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry or voting process or the operation of the Sweepstakes; (b) violating the Official Rules; or © acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Additionally, Sponsors reserve the right, at their sole discretion, to disqualify any votes/downloads it deems to be irregular votes/downloads or votes/downloads cast in violation of either the wording and/or intent of these Official Rules and to disqualify any Submitter, it believes to have acted in violation of these Official Rules.
RELEASE: By participating, each entrant releases and agrees to indemnify and hold harmless Sponsors & Others from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes or arising out of participation in any Sweepstakes-related activity or Prize related activity, whether hosted by Sponsors or a third party, or the receipt, use or misuse, of any Prize. You agree that the laws of the State of Massachusetts, without regard to its conflicts of laws principles, shall govern the Sweepstakes, and you agree to jurisdiction and venue in the federal or state courts located in the State of Massachusetts. You waive all rights to claim or collect punitive, incidental, consequential, or any other damages. You agree that all causes of action arising out of or connected with the Sweepstakes shall be resolved individually without resort to any form of class action.
